Arizona Sentence Ordered Reconsidered After AI Victim Video
An Arizona appeals court reportedly ordered resentencing because an AI-generated victim video improperly influenced sentencing. The conviction remains in place, while the prison term must be reconsidered.

The victim avatar was shown during sentencing
404 Media reported that Gabriel Horcasitas, convicted of manslaughter in the 2021 killing of Christopher Pelkey, must be resentenced. Pelkey's sister had played an AI-generated avatar of Pelkey delivering words she wrote as part of her victim-impact statement. The report says the appellate court concluded that the lifelike recreation improperly affected the judge, while leaving the conviction in place.
At the original sentencing, the judge imposed the maximum prison term of 10 and a half years after viewing the victim-impact video, according to the report.
An Arizona appellate court reportedly left the manslaughter conviction intact but required the sentencing judge to reconsider the prison-term length because consideration of the AI video made the procedure fundamentally unfair.
The reported ruling treats the emotional force and apparent authenticity of a synthetic likeness as relevant to whether a sentencing process was fair. It concerns an AI avatar used after a guilty verdict, not evidence shown to a jury.
